By using the Site or requesting our services, you agree to these Terms.
You may use the Site to learn about our services, request quotes and inspections, and contact us. You agree not to misuse the Site, attempt to gain unauthorized access, disrupt its operation, scrape it in bulk, or use it in any way that would violate applicable law. We may modify, suspend, or discontinue any part of the Site at any time without notice.
The Site is not a substitute for calling 911 or your local emergency services. If there is an active fire, gas leak, electrical hazard, structural collapse risk, or immediate threat to life or safety, leave the property and contact emergency services first. Web forms are checked during business hours; for restoration emergencies, call 888-929-0045.
Any pricing, response time, or scope information on the Site is general and for informational purposes only. A binding estimate can only be provided after an on-site inspection and, where applicable, coordination with your insurance carrier. Emergency mitigation work performed before a full scope is issued is billed at our standard rates and captured in the final written estimate.
Restoration services are performed only after you sign an authorization form and, where applicable, a direction-to-pay authorizing your insurance carrier to remit payment directly to Aqua Restoration Services. You remain responsible for any deductible, non-covered amounts, or supplemental work you authorize in writing. Cancellation, rescheduling, and after-hours policies are described in your signed authorization.
We work with most major carriers and will document the loss to industry standards, but we do not provide insurance advice, adjust claims, or guarantee coverage decisions. Coverage determinations are made solely by your insurance carrier and adjuster. Any statements we make about likely coverage are informational, not guarantees.
We warrant that services will be performed in a workmanlike manner consistent with industry standards, including the IICRC S500 (water), S520 (mold), and S700 (fire) reference standards where applicable. Except as expressly stated in a written contract or authorization form, we make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
The Site itself is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Aqua Restoration Services, its owners, employees, and contractors are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or our services, including lost profits, business interruption beyond the coverage of your insurance policy, or damage to belongings we were not engaged to protect. Our total liability arising from any single loss will not exceed the amount actually paid by you for the specific service giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct, fraud, or personal injury caused by our negligence.
You represent that you are the owner of the property being serviced, or authorized to consent to the work on behalf of the owner. You are responsible for disclosing known hazards (asbestos, lead paint, biological contamination, unstable structures, live wires, hazardous materials) so we can plan appropriate safety measures. If unknown hazardous materials are discovered during work, we may pause the job pending appropriate testing and coordination.
Payment terms are set out in your signed authorization or estimate. Balances not paid within the terms stated may accrue interest at the maximum rate allowed by Texas law. In the event of nonpayment, we may file a mechanic's or materialman's lien as permitted under Texas Property Code Chapter 53. You are responsible for reasonable collection costs and attorney's fees in the event of collection.
All content on the Site — including text, graphics, logos, photographs, and the Aqua Restoration Services name and shield mark — is owned by or licensed to us and protected by copyright and trademark law. You may not reproduce, republish, or use the content for commercial purposes without our written permission. Testimonials and customer photos are used with permission.
The Site may link to third-party websites (such as insurance carriers, RingCentral, or industry organizations). We do not control and are not responsible for the content or practices of those sites.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief or filing a mechanic's lien where appropriate.
We may update these Terms from time to time. The effective date at the top of this page reflects the most recent version. Continued use of the Site after an update constitutes acceptance of the revised Terms.
